May improve use of the Welsh language by bringing communities together

Crynodeb o'r Gynrychiolaeth:

There needs to be more weight given to the different types of food growing spaces that can be provided in association with new development - large or small, commensurate to the size of development.
We need to move away from the view we should ask for growing spaces only on larger housing sites. Community allotments are fine but we also need smaller blank canvass spaces for food growing that communities can take ownership of. These are not capital intensive asks. We need to raise awareness of the different types of food growing spaces that can be provided.

I support these points but the council needs to work better to actually action their own plans.

Delivery of new or improved infrastructure must be undertaken in a timely and coordinated manner to meet the needs of existing and planned communities *prior to* the commencement of any development.

Crynodeb o'r Gynrychiolaeth:

The requirement to provide welsh language facilities is considered onerous. How would a developer provide Welsh language facilities as part of a development? What would this mean in practice, and for how long would they be required? The HBF suggests that a contribution towards Welsh Language improvements would be more appropriate, and would allow for an instance, a financial contribution to support existing facilities. Such an approach is common across other LDPs.

In terms of the Welsh Language, the Council's Background paper BP30 concludes:
'The evidence presented in this background paper demonstrates that the Welsh language, while an important part of Wales’s cultural heritage, does not hold a position of significant cultural prominence within the Vale of Glamorgan and that the RLDP is unlikely to materially influence the status, use or vitality of the Welsh language within the area.'

This would suggest that the requirements of the plan should not be overly onerous.

Concerning employment opportunities, the use of the phrase 'complementary facilities' is very vague. With regard to the example of the provision of training and working hubs, it is unlikely to be achievable on the scale of the developments proposed in the plan. A contribution towards such facilities in the wider area is likely to be more achievable, helping support existing facilities, rather than creating more that last only for the length of the development.

Mitigation of Severn Estuary Recreational Pressure: It would be helpful in the supporting text to reference Policy DNP8 – SEVERN ESTUARY RECREATIONAL PRESSURE. Is there any information available on how this will be calculated?

Crynodeb o'r Gynrychiolaeth:

The inclusion of the allowance for development viability in Policy SP13 is endorsed. It is vital that the Council take account of development viability when considering community infrastructure and planning obligations. To not do so, could jeopardise whole allocations which would undermine the delivery of much needed affordable and market housing in VoG. With regards to Affordable Housing Led Allocations, care needs to be taken to ensure that any additional planning obligations beyond the affordable housing are carefully considered in terms of overall viability.

As drafted, Policy SP13 is consistent with PPW and meets the three tests of soundness.

Crynodeb o'r Gynrychiolaeth:

The inclusion of development viability considerations in Policy SP13 is endorsed. The need to balance additional planning obligations with overall viability is essential to prevent jeopardising housing delivery. Policy SP13 aligns with PPW guidelines, ensuring that community benefits are reasonably related to developments and do not compromise site deliverability. It is considered that Policy SP13 as drafted meets the three tests of soundness and supports the delivery of affordable and market housing in VoG.

A very positive effect with greater use and take up of spaces

Crynodeb o'r Gynrychiolaeth:

SF&G disagree with the current wording that begins with 'where appropriate and having regard to viability,' as it invites developers to argue this does not apply to their site. We suggest changing it to state that the Council aims to secure high-quality community infrastructure, facilities, and services appropriate to the development’s scale, type, and location with site viability a consideration. Community growing spaces should be provided, and references to allotments should be deleted, encouraging developers to create spaces of appropriate size with minimal capital costs (enabling 'community ownership'). The preferred approach remains on-site provision of facilities and infrastructure.

Crynodeb o'r Gynrychiolaeth:

Policy SP13 refers to securing infrastructure through planning obligations. However, reliance on financial contributions alone does not ensure timely delivery.

There is insufficient clarity regarding:
- Education capacity expansion.
- Primary healthcare provision.
- Highway mitigation triggers.
- Public transport enhancement sequencing.

Infrastructure must be delivered ahead of, or in tandem with, housing occupation - not retrospectively.

SP13 Community infrastructure and planning obligations: We want to take this opportunity to highlight the challenges that population growth places on healthcare
services. The projected level of population growth identified within the RLDP will have an impact on the CAVUHB's community healthcare facilities and infrastructure.

Please refer to the information provided as part of the background evidence paper titled 'BP37 Primary, Community and Intermediate Health Care 'for more detail on the CAVUHB response which identifies there is limited scope for the current infrastructure within existing GP premises to absorb the LDP growth. CAVUHB recognises the need to prioritise the expansion of the existing estate (where feasible) or support new developments to take forward its strategic objectives.

Persimmon Homes do not consider that Policy SP13 – Community Infrastructure and Planning Obligations is required. This is predicated on the basis that such matters are dealt with under separate legislative and policy frameworks. Therefore, as currently drafted the proposed policy (and supporting text) do not add anything further information for planning purposes and risk unnecessary duplication.

Crynodeb o'r Gynrychiolaeth:

We support the provisions within the policy that the Council will secure new and improved community infrastructure where appropriate and within a timely manner, and the specific reference to utilities infrastructure. Where existing water and sewerage infrastructure requires reinforcement to serve a development it must be provided as part of the development to mitigate any adverse impacts. In circumstances where the development generates the need for infrastructure improvements that are not programmed for delivery by infrastructure providers then it must be funded by the development. Therefore, it is important for developers to engage early with relevant infrastructure providers, including the statutory sewerage and water undertaker. We welcome that the policy states that improved infrastructure must be undertaken in a timely manner. The delivery of reinforcements to the sewerage and water networks can controlled either through planning condition or a commercial agreement between the developer and Welsh Water.
Adequate potable water supply and drainage infrastructure is key to ensuring new development sites are sustainable, viable and deliverable. Hydraulic modelling assessments (HMA) may be required to determine an adequate point of connection to the water network and/or public sewers, and developers would be strongly recommended to fund investigations at pre-planning stage. Once commissioned and completed the HMA would identify suitable connection points and/or the necessary reinforcement works required to accommodate the development (for example upsizing sewers/water mains, additional storage tanks etc). In certain circumstances surface water removal could be an alternative option for allocations where foul sewer HMAs are being requested, and we would welcome early engagement with the site developer.
The reinforcements required to the network would be established by the HMA and costings would be provided at detailed design stage. The developer would need to fund a scheme by way of the requisition provisions of the Water Industry Act or via a legal/commercial agreement with Welsh Water.

Crynodeb o'r Gynrychiolaeth:

It must be recognised in the policy or supporting text that the delivery/timing of some infrastructure measures will be outside the control of developers/developments. This is particularly the case where financial contributions are made, and measures will be delivered by others. Flexibility should therefore be allowed for through Policy SP13.

Policy SP13 demonstrates the importance of community infrastructure in sustaining both the residents well being and economic growth of an area. To see in Policy SP13 that ‘development viability’ is recognised as a key factor in delivering community infrastructure under planning obligations, is supported.
