Crynodeb o'r Gynrychiolaeth:

This representation is informed by structured community engagement undertaken by the Community Council, which received 129 responses from residents of Wick and the immediate surrounding area (copy of the responses and summary attached).
The Council provides the following comments with reference to the Welsh Government tests of soundness.

Infrastructure Capacity & Delivery (CE1 & CE2)
A key concern raised through community engagement relates to infrastructure capacity.
Survey responses indicate that:

• 73% consider existing infrastructure to be inadequate or very inadequate
• 90% believe infrastructure improvements should be delivered prior to or alongside development.
Residents have highlighted concerns regarding:
• drainage capacity
• traffic and highway impacts
• school capacity
• public transport accessibility
The Council therefore requests clarification on the evidence supporting the capacity of existing infrastructure and how any necessary upgrades would be delivered and funded.

Site Access & Highway Considerations
Residents have raised concerns regarding the potential construction access and operational access arrangements for the site.
In particular, questions have been raised about whether construction traffic or site access could occur through the St James Gardens estate, which includes a relatively narrow access road serving an existing residential development.
Concerns raised relate to:

• potential construction traffic movements
• safety considerations for existing residents
• proximity to areas used by children for recreation
• suitability of the road network for large construction vehicles

The Council requests clarification on:
• the proposed access arrangements for the site
• whether the St James Gardens estate is expected to provide access
• any highway safety assessments that have been undertaken

Environmental & Open Space Considerations (C1)
Community responses demonstrate strong support for protecting green space around the village, with all respondents indicating that protection of green space is important.
The Council therefore requests confirmation that environmental constraints and landscape impacts have been fully assessed within the site selection process.

In conclusion Wick Community Council respectfully requests that the Inspector and the Council consider the following matters in assessing the soundness of the plan:

• The justification for selecting the Heol Fain site within the settlement strategy.
• Whether the scale of development proposed is proportionate to the size and character of Wick.
• Evidence relating to infrastructure capacity and delivery.
• Highway access arrangements and potential safety implications.
• Environmental and landscape considerations.

The Community Council would welcome further clarification regarding the evidence base supporting this allocation.

Crynodeb o'r Gynrychiolaeth:

Procedural Soundness (P1 & P2)
The Community Council seeks clarification regarding the evidence base supporting the identification of this site.
Specifically:
• What planning and site assessment criteria led to the identification of land east of Heol Fain as suitable for allocation?
• How this decision aligns with earlier plan-making stages where the site was not progressed.
• How cumulative growth in Wick since the adoption of the previous Local Development Plan has been assessed in determining the appropriateness of further allocations.
Understanding the reasoning behind the selection of this site would assist the community in understanding how it fits within the overall spatial strategy.

Proportionality of Growth
Community responses indicate that while a majority of residents oppose further housing growth in Wick, there is some acceptance that small-scale development may be appropriate, particularly where it reflects the scale and character of the village.
Survey responses indicate that:

• 47% prefer no additional housing
• 41% would support small-scale development (fewer than 20 homes)
This suggests that, where development occurs, residents consider that smaller sites may be more proportionate to the size and character of the settlement.

Affordable Housing & Local Connection
Community responses indicate that while views on additional housing are mixed, there is clear support for ensuring that any affordable or social housing provision benefits those with established local connections to the village.
Survey responses show that:

• 44% support the inclusion of affordable or social housing in principle
• 39% oppose
• 17% are unsure
However, where affordable housing is delivered, 78% of respondents indicated that priority should be given to applicants with existing family or employment links to Wick.
This outcome highlights a strong community preference for ensuring that affordable housing provision supports the sustainability of the local community, particularly for:
• younger residents wishing to remain within the village
• families with established local ties
• individuals currently priced out of the local housing market

The Community Council therefore asks that, should development proceed, consideration is given to mechanisms which prioritise local connection criteria where consistent with housing policy.

Crynodeb o'r Gynrychiolaeth:

Consideration of this site for development is inconsistent with the decision made by the LPA to remove it from the current LDP.
Wick has already seen significant growth. With this site, Wick will have doubled in size. How can there be any further demand. Evidence shows there is very little affordable housing requirement in the St Brides Ward and demonstrates its unsuitability for affordable housing due to poor public transport, lack of services, and few employment opportunities.
Inconsistent assessment of candidate sites and planning applications.
This site was deemed unsuitable in the original candidate site register and now reconsidered for affordable housing. No formal notification to Wick Community Council or elected members to explain why this decision had been made. Therefore, there was no opportunity to raise objections.
Demonstrates a lack of consideration for the local community and a lack of ambition to protect rural villages.
The Council have no legal interest in St James Gardens. To permit access for construction traffic from St James Gardens raises public safety concerns.
Drainage issues in the St James Garden development have not been resolved and the system has not been adopted by Dwr Cymru.
Access and parking problems exist throughout surrounding roads. This will be made worse with further housing and make access to any new development impossible.
If the whole site had been allocated earlier, the development would have been planned with regard to its size and constraints, rather than becoming an unplanned add-on with significant consequences.
Can the Vale Council explain why it has removed site 355 from the RDLP in favour of 404. Site 355 does not have any of the complications associated with site 404, has the benefit of direct access from St Brides Road, replicates the linear form of existing residential development and minimises impact on the open countryside.

Crynodeb o'r Gynrychiolaeth:

The site it is physically, legally, and infrastructurally connected to the nearby residential area. The site complements the existing development. We are committed to working with the Council for its timely development, addressing local rural housing needs effectively.

The Site is readily accessible via St James Road. The Supplemental Agreement dated 20 November 2015, which includes the Transfer details, confirms that the estate road linking the Site to the adopted highway at St Brides Road was expressly intended to serve the retained land (the Site) without the creation of any ransom position. The registered title also confirms the absence of any legal impediments to utilising this access. Furthermore, access through St James Gardens does not require consent from the private management company, and the title register confirms no restrictions that would prevent vehicular or pedestrian access via this established route.

This position is reflected in the signed Legal Agreement for the sale of the freehold property which has already been developed by BDW Trading Limited. Clause 13.5 states “The Buyer shall ensure that in any planning layout in respect of the Property that the layout provides for the benefit of pedestrian and vehicular access to the boundary between the Property and the Retained Land by means of the construction of a roadway to be built to adoptable standards leading to the boundary between the Property and the Retained Land to enable the continuing access and egress from the Retained Land over the Property, but subject always to the same having been approved by the local planning authority and/or local highway authority”.

Additionally, the title and plan for the retained land (WA986140) also notes that an easement has been registered pursuant to the terms of the agreement with BDW and the Land Transfer.

Crynodeb o'r Gynrychiolaeth:

Water Supply - A hydraulic modelling assessment (HMA) will be required.
Wastewater - The public sewerage network can accept potential foul flows from this development site. A 6” diameter abandoned sewer crosses the site. The site is near to a Sewage Pumping Station (SPS) and we would recommend that the LPA discuss the potential allocation with their Environmental Health Department. To avoid the potential for noise or odour nuisance for future occupiers it is strongly recommended that any properties are positioned a minimum of 15 metres away from the asset.
Wastewater Treatment Works - Wick WwTW has capacity to accept foul flows from the proposed development.

Whilst no clearly evident deficiency exists in respect to the site, it is known that Wick has been subject to significant growth and expansion in recent years – not least by virtue of significant housing allocations in the settlement as part of previous plans.

Other similarly sized and comparable settlements and locations have not by contrast been subject to any growth for some considerable time, and accordingly would warrant and benefit from provision as part of this new replacement plan.
